Sweepstakes Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. ENTRANTS NEED ONLY BE “FANS” OF, OR “LIKE,” SPONSOR’S FACEBOOK PAGE TO ENTER. THE PURCHASE OF ANY GOOD AND/OR SERVICE WILL NOT INCREASE AN ENTRANT’S CHANCE OF WINNING.
1. SWEEPSTAKES SPONSOR; TERM. The Mother’s Day sweepstakes (the “Sweepstakes”) is sponsored by Gerber Childrenswear LLC (the “Sponsor”). The Sweepstakes entry period starts April 23, 2013 at 9:00 a.m. Eastern Daylight Time ("EDT") and ends on May 12, 2013, at 11:59 p.m. EDT (the “Term”). All entries received after 11:59 p.m. EDT on May 12, 2013, will be ineligible for participation. If Sponsor does not receive an entry for any reason, or if an entry is not entered correctly, the entry will be invalid and the entrant will be ineligible for a prize.
2. ELIGIBILITY. ONLY LEGAL RESIDENTS, WHO ARE 18 YEARS OF AGE OR OLDER, OF THE 50 U.S. STATES AND THE DISTRICT OF COLUMBIA, EXLUDING RESIDENTS OF RHODE ISLAND AND/OR THOSE STATES WHERE THIS SWEEPSTAKES IS PROHIBITED BY LAW, ARE ELIGIBLE TO ENTER OR WIN. Neither Sponsor nor any of its affiliates warrants that this Sweepstakes is valid in a particular jurisdiction. Residents of jurisdictions where this Sweepstakes is prohibited are ineligible to compete in the Sweepstakes. An individual (a “Fan”) must be a Facebook “fan” of, or “like,” Sponsor’s Facebook page (www.facebook.com/gerberchildrenswear) (“Sponsor’s Facebook Page”) to enter the Sweepstakes. Employees of Sponsor or any of its affiliates, subsidiaries, advertising and promotion agencies, or of any company retained by Sponsor to promote, administer, or advise with respect to the Sweepstakes (and their respective affiliates), as well as members of said employees’ immediate families, are not eligible to enter. A Fan is not eligible to win more than one Sweepstakes prize.
3. HOW TO ENTER; RESTRICTIONS. Fans must enter the Sweepstakes at the “Sweepstakes” tab of Sponsor’s Facebook Page, using the North Social application on the Facebook platform found there. Each entry must include the Fan’s name, mailing address, e-mail address and entrant’s date of birth. In the event of a dispute, an entry will be deemed to have been submitted by the owner of the Facebook account from which it was sent. For these purposes, a Facebook account owner shall mean the natural person assigned to such account by Facebook. Different prizes will be awarded weekly to winners randomly selected from Fans who entered the Sweepstakes that week. A Fan may enter the Sweepstakes once each week during the Term. If multiple entries are submitted by any person in a single week, only the first entry received by Sponsor (as determined by Sponsor in its sole discretion) will be entered in the Sweepstakes. A Fan who wins a Sweepstakes prize is not eligible to win additional prizes during the Term. In the event that a Fan who has won a prize enters the Sweepstakes in a subsequent week and is selected randomly as a winner for that week, the Fan will forfeit the prize to another winner, to be selected by Sponsor in its sole discretion.
4. PRIZES: 11 Winners Each Week, 33 Total Winners, $3000 Total Prize Value. Sweepstakes winners will be selected on the following schedule and receive the following prizes:
- An eligible Fan who registers between 9:00 a.m. on Tuesday, April 23, 2013, and 11:59 p.m. on Sunday, April 28, 2013, may be randomly selected as one of ten (10) runner-ups of a fifty ($50) dollar American Express gift card or the one (1) grand prize winner of a five-hundred ($500) dollar American Express gift card.
- An eligible Fan who registers between 12:00 a.m. on Monday, April 29, 2013, and 11:59 p.m. on Sunday, May 5, 2013, may be randomly selected as one of ten (10) runner-ups of a fifty ($50) dollar American Express gift card or the one (1) grand prize winner of a five-hundred ($500) dollar American Express gift card.
- An eligible Fan who registers between 12:00 a.m. on Monday, May 6, 2013, and 11:59 p.m. on Sunday, May 12, 2013, may be randomly selected as one of ten (10) runner-ups of a fifty ($50) dollar American Express gift card or the one (1) grand prize winner of a five-hundred ($500) dollar American Express gift card.
5. SELECTION OF WINNERS. Weekly winners will be selected randomly following each week in the Term.
6. NOTIFICATION, RECEIPT OF PRIZES. Winners will be notified by an announcement on Sponsor’s Website within seven (7) days after the end of each week during the Term. Winners also may be notified by certified mail and/or email, in Sponsor’s sole discretion, within fifteen (15) days after the Sweepstakes ends. In the event of non-compliance with any of the rules set forth herein, or if any prize notification is returned as undeliverable, a winner’s prize may be forfeited and awarded to an alternate winner, to be selected by Sponsor in its sole discretion. Sponsor is not responsible for, and shall not be liable for, late, lost, misdirected, or unsuccessful efforts to notify a winner. Winners will receive their prizes within fifteen (15) business days after Sponsor’s receipt of any authorization, affidavit, release, or other form or verification requested by Sponsor under these Sweepstakes Rules.
7. SWEEPSTAKES WINNERS: The names of the Winners may be posted on Sponsor’s Facebook Page, website (www.gerberchildrenswear.com) (“Sponsor’s Website”), or Twitter account (www.twitter.com/gerberwear). The identity of the winners can also be obtained by writing to Gerber Childrenswear LLC, Attn: Marketing, 7005 Pelham Rd., Suite D, Greenville, SC 29615.
8. USE OF IMAGES AND LIKENESS; RELEASES. By accepting a prize, winners agree (to the extent permitted by their states’ laws, including those of Tennessee) and grant Sponsor and those acting under Sponsor’s authority, at Sponsor’s sole discretion, an irrevocable, royalty-free, worldwide, non-exclusive license to use their names, biographical information, pictures/portraits, likenesses, and/or voices in connection with any current or future media for advertising and promotional purposes without further compensation, unless prohibited by law. Potential winners shall be required to sign and return within ten (10) days of Sponsor’s request an Affidavit or Declaration of Eligibility, Liability Release, and where legally permissible a Publicity Release, BY ACCEPTING A PRIZE, WINNERS AGREE THAT SPONSOR, ITS PARENT COMPANY, AFFILIATED COMPANIES, AGENTS, RETAILERS, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNERS FOR ANY LIABILITY, INJURY, LOSS, OR DAMAGE OF ANY KIND, INCLUDING DEATH, TO PERSONS AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES. All entries become the sole property of Sponsor and will not be returned. Notwithstanding any rule herein, a Fan has the right to refuse to provide personal information to Sponsor in accordance with any applicable laws. Should a Sweepstakes winner refuse to provide a mailing address to Sponsor, the winner’s prize may be forfeited and awarded to an alternate winner. Before providing any personal information, please read our Privacy Policy, which is available at www.gerberchildrenswear.com, or upon request from Gerber Childrenswear LLC, Attn: Marketing, 7005 Pelham Rd., Suite D, Greenville, SC 29615. By submitting a completed entry form, you consent to the collection, processing, use and disclosure of the information contained in your entry form according to our Privacy Policy.
9. GENERAL CONDITIONS. THIS SWEEPSTAKES IS VOID IN RHODE ISLAND AND/OR WHERE PROHIBITED BY LAW. A copy of these rules may be obtained at Sponsor’s Facebook page or Website, or by sending a self-addressed stamped envelope to: Gerber Childrenswear LLC, Attn: Marketing, 7005 Pelham Rd., Suite D, Greenville, SC 29615 within thirty (30) days of the Sweepstakes’ deadline date. Residents of Vermont may omit return postage. Questions regarding this Sweepstakes may be sent to Gerber Childrenswear LLC, Attn: Marketing, 7005 Pelham Rd., Suite D, Greenville, SC 29615. By entering the Sweepstakes, Fans agree to these rules and all eligibility requirements and all decisions of Sponsor. Decisions of the Sponsor are final on all matters relating to this Sweepstakes. The reporting and payment of all tax liabilities incurred by any winner as a result of the Sweepstakes are the sole responsibility of the winner. All federal, state, and local laws and regulations apply. Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, expressed or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose EXCEPT as expressly specified on the product by the manufacturer. No substitution of prizes will be permitted, except by Sponsor, who may substitute a prize of equal or greater value if the advertised prizes become unavailable. Prizes are non-transferable and may not be redeemed for cash. Odds of winning will be dependent upon number of entries received. If for any reason the Sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error, act of God, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and award prizes from among all eligible entries received prior to cancellation or termination. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, mail delivery error or delay, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, any combination thereof, or otherwise, including any injury or damage to Fan's or any other person's computer related to or resulting from participation or downloading any materials in the Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS; SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM OR CRIMINAL SANCTIONS AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
10. RIGHT OF NON-PARTICIPATION: Pursuant to federal law, any individual has the right to notify Sponsor that she does not wish to be contacted by Sponsor regarding any future Sweepstakes, contest, promotion, or mailings, and that Sponsor may not use any information provided to it by such individual for any purposes other than as needed for this Sweepstakes. Sponsor may be so notified by mail at Gerber Childrenswear LLC, Attn: Marketing, 7005 Pelham Rd., Suite D, Greenville, SC 29615 (or by calling the toll free number, 1-800-4-GERBER). If no Fan qualifies for any prize to be awarded pursuant to this Sweepstakes, then the prize or its equivalent cash value may be awarded to a charity of the Sponsor’s choice. Sponsor reserves the right to verify the eligibility qualifications of winners. This Sweepstakes is governed by U.S. and applicable state law. By entering the Sweepstakes (or pressing the submit button for e-mail or Facebook transmission) you have agreed to all the rules and conditions of the Sweepstakes as set forth herein.
